Update: On March 27, 2020, at the request of the Ohio Democratic Party, the Court dismissed this complaint since the matter has been resolved by legislative action.

On March 17, 2020, the Ohio Democratic Party filed a lawsuit, State ex rel. Ohio Democratic Party and Kiara Diane Sanders v. Frank LaRose, in his official capacity as Ohio Secretary of State, requesting that a writ of prohibition be issued to prevent Respondent Ohio Secretary of State Frank LaRose from setting the date of Ohio’s 2020 presidential primary election.  Read the complaint here.

On March 18, 2020, the Supreme Court of Ohio, sua sponte, in an order signed by Chief Justice Maureen O’Connor, issued the following expedited briefing schedule:

Respondent shall file an answer to the complaint by Friday, March 20, 2020; relators shall file their brief and evidence no later than Monday, March 23, 2020; respondent shall file his brief and evidence no later than Wednesday, March 25, 2020; and relators shall file their reply brief no later than Friday, March 27, 2020. It is further ordered that no requests or stipulations for extension of time shall be filed and the clerk of court shall refuse to file any requests or stipulations for extension of time.
