On February 21, 2017, the U.S. Supreme Court turned down the cert. petition filed by the state in Ohio v. Hand. The question presented was

“Whether the absence of the right to trial by jury in juvenile delinquency proceedings results in a juvenile adjudication falling outside the prior-conviction exception set out in Apprendi v. New Jersey.”

So, the 4-3 decision from the Supreme Court of Ohio, State v. Hand, 2016-Ohio-5504, that it is unconstitutional to use a juvenile adjudication as the equivalent of an adult conviction to enhance a penalty for a later crime, will stand.
