On June 14, 2016, the Supreme Court of Ohio heard oral argument in the case of State ex rel. Cincinnati Enquirer v. Deters. At issue in this mandamus action is whether a prosecutor’s office must release police officer bodycam footage (specifically, in this case, the video of the traffic stop in which Samuel Dubose was killed by University of Cincinnati police officer Ray Tensig) to the public immediately upon request in order to comply with the Ohio Public Records Act. Appearing to argue the case on behalf of respondent Joe Deters, the Hamilton County Prosecutor, was former Justice Andy Douglas, who retired from the bench December 31, 2002 because of the mandatory retirement age for justices.
